1. About Sunny Shades

Sunny Shades Resort & Spa (“Sunny Shades”, “we”, “us”, “our”) provides accommodations and recreational services, including but not limited to cottages, trailers, RV sites, tents, seasonal trailers, boat launches, boat rentals, pontoon rentals, day passes, and event or wedding spaces.

2. Booking Requests and Holding of Services

2.1 Non-Binding Booking Requests

• Booking selections made on the Website constitute a request to hold services, not a confirmed reservation.
• Availability displayed on the Website is indicative and subject to verification.

2.2 Confirmation Process

After a booking request is submitted, Sunny Shades' support team may contact you to confirm availability, pricing, terms, billing, and payment.

A booking is confirmed only after:

• written confirmation by Sunny Shades; and
• receipt of required payment or deposit.

2.3 Right to Decline or Modify Requests

Sunny Shades reserves the right to:

• decline any booking request;
• modify dates, services, or pricing prior to confirmation; or
• cancel unconfirmed holds at any time without liability.

3. Pricing and Payment

3.1 Indicative Pricing

• Prices displayed on the Website are estimates and may change without notice.
• Final pricing will be confirmed by Sunny Shades prior to booking confirmation.

3.2 Taxes and Fees

All prices are subject to applicable federal, provincial, and local taxes (including HST in Ontario), fees, and surcharges unless otherwise stated.

3.3 Payment Terms

• Deposits, full payments, or security deposits may be required depending on the service.
• Accepted payment methods will be communicated during confirmation.
• Failure to complete payment within the specified timeframe may result in cancellation.

4. Cancellation, Refunds, and Changes

4.1 Cancellation Policy

• Cancellation terms vary by service type (accommodation, rentals, events, day passes, etc.).
• Specific cancellation terms will be provided during booking confirmation.
• Unless otherwise stated, deposits may be non-refundable.

4.2 Changes

Requests for changes to confirmed bookings are subject to availability and additional charges.

Sunny Shades shall not be liable for failure to provide services due to events beyond reasonable control, including but not limited to natural disasters, government orders, weather conditions, or public health emergencies.

5. Guest Responsibilities

5.1 Conduct and Compliance

Guests must:

• comply with all resort rules, policies, and applicable laws;
• behave responsibly and respectfully toward staff, other guests, and property.

5.2 Responsibility for Belongings

• Guests are solely responsible for their personal belongings, vehicles, and equipment.
• Sunny Shades is not liable for loss, theft, or damage to personal property except where required by law.

5.3 Damage and Liability

• Guests are responsible for any damage caused to resort property by themselves or their guests.
• Sunny Shades may charge repair or replacement costs to the guest.

5.4 Safety and Risk Assumption

• Many resort activities involve inherent risks (e.g., boating, swimming, outdoor activities).
• Guests participate at their own risk and must follow safety instructions and regulations.

6. Use of Facilities and Services

6.1 Eligibility

Certain services may require minimum age, valid identification, licenses, or waivers.

6.2 Equipment Rentals

• Renters must inspect equipment before use.
• Responsibility for safe and lawful use rests with the renter.

6.3 Events and Weddings

Separate contracts and policies may apply for events, weddings, and large group bookings.

7. Website Use

7.1 Accuracy of Information

While we strive to ensure accuracy, Sunny Shades does not guarantee that Website information is complete, accurate, or current.

7.2 Intellectual Property

All Website content is owned by Sunny Shades or its licensors and may not be reproduced without permission.

7.3 Prohibited Use

Users must not misuse the Website, including through hacking, fraud, or unlawful activities.

8. Privacy and Data Protection

Personal information is handled in accordance with Sunny Shades' Privacy Policy and applicable Canadian privacy laws, including PIPEDA and Ontario legislation.

• Liability for any claim shall be limited to the amount paid by the customer for the relevant service.

Nothing in these Terms limits rights that cannot be excluded under applicable consumer protection laws.

10. Indemnification

You agree to indemnify and hold harmless Sunny Shades from claims arising from your breach of these Terms, misuse of services, or violation of law.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Ontario and the laws of Canada applicable therein. Any disputes shall be resolved exclusively in the courts of Ontario.

12. Amendments

Sunny Shades may update these Terms at any time. Updated Terms will be posted on the Website and apply from the date of publication.
